Terms and Conditions (T&C) of Weckerle & Haarmann Living GbR

1. General Provisions

1.1 These Terms and Conditions ("T&C") apply to all rental agreements and services concluded between Weckerle & Haarmann Living GbR (hereinafter referred to as "Landlord") and its customers (hereinafter referred to as "Tenant") via the website www.whliving.de.

1.2 Deviating, conflicting, or supplementary terms of the Tenant will not become part of the contract unless the Landlord expressly agrees to their validity in writing.

2. Subject of the Agreement

2.1 The Landlord rents furnished studios and apartments for the agreed period.

2.2 The exact equipment of the accommodations and further details can be found in the respective description on the website www.whliving.de.

3. Booking and Conclusion of Contract

3.1 Booking is done via the website www.whliving.de. By completing the booking process, the Tenant submits a binding offer to conclude a rental agreement.

3.2 The contract is only concluded upon confirmation of the booking by the Landlord, which is sent by email.

4. Prices, Payment, and Cancellation Policy

4.1 Prices are based on the valid price information on the website at the time of booking.

4.2 Payments are due immediately or upon agreement but no later than 14 days before arrival. Accepted payment methods will be displayed during the booking process.

4.3 In case of payment default, the Landlord reserves the right to terminate the contract extraordinarily.

4.4 Cancellation Policy:

4.4.1 For short-term bookings (less than 28 days stay): The guest can cancel free of charge up to 24 hours before the planned check-in. After that, the full rental price will be charged.

4.4.2 For long-term bookings (30 days or more stay):

4.4.2.1 Cancellations up to 30 days before check-in: 50% of the total price will be charged.

4.4.2.2 Cancellations less than 30 days but at least 14 days before check-in: 50% of the total price will be charged.

4.4.2.3 Cancellations less than 14 days before check-in or in case of no-show: 100% of the total price will be charged.

4.5 To amend or cancel a booking, please email booking@whliving.de. Refunds will be processed within 7 days to the original payment method.

4.6 The cancellation policy does not apply if the booking was made using a prepayment discount.

5. Check-in and Check-out

5.1 Check-in is possible from 3:00 PM, and check-out must be completed by 11:00 AM at the latest. Deviations can be individually agreed upon with the Landlord.

5.2 In case of late check-out without prior agreement, the Landlord reserves the right to charge an additional fee.

6. Use of the Accommodation

6.1 The accommodation may only be used for residential purposes. Any commercial use is prohibited.

6.2 The Tenant is obligated to treat the accommodation with care and to report any damages occurring during the stay to the Landlord immediately.

6.3 Smoking is prohibited in the accommodations. In case of violation, a cleaning fee of 250 EUR will be charged.

7. Liability

7.1 The Landlord is only liable for intent and gross negligence. Liability for indirect damages or lost profits is excluded.

7.2 The Tenant is fully liable for any damages caused by them or their guests.

8. Data Protection

8.1 The Landlord collects and processes the Tenant's personal data exclusively within the framework of applicable data protection laws. Further information can be found in the privacy policy on www.whliving.de.

9. Final Provisions

9.1 The law of the Federal Republic of Germany applies. The place of jurisdiction, as far as legally permissible, is the registered office of the Landlord.

9.2 Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected. Instead of the invalid provision, a regulation that comes closest to the economic purpose of the invalid provision shall apply.
